Substandard and Falsified Medical Products

Substandard and falsified medical products are the two halves of a deliberately precise terminology adopted by World Health Organization member states in 2017 to replace the vaguer language of counterfeit medicines. Substandard products are authorised articles that fail to meet their own quality specification or their marketing authorisation, typically through a manufacturing or storage failure: out-of-specification content, degradation, failed sterility. Falsified products deliberately misrepresent their identity, composition or source. The third category in the same scheme, unregistered or unlicensed products, covers articles that have simply not been assessed by the relevant authority.

The distinction was drawn because the word counterfeit had been entangled with trademark law, which framed the problem as a commercial dispute between rights holders rather than a patient-safety failure, and which left substandard product from an entirely legitimate factory outside the discussion. WHO's global surveillance work has estimated that around one in ten medical products circulating in low- and middle-income countries is substandard or falsified.

The practical value of the split is diagnostic. Substandard product implies a process failure and is addressed through inspection, specification and stability control. Falsified product implies criminal intent and is addressed through supply-chain verification and law enforcement. The same failed assay result points at completely different remedies depending on which it is.

The confusion worth avoiding is treating a genuine-looking, correctly branded product as necessarily authentic, and an unbranded one as necessarily fake. Falsification targets appearance because appearance is what buyers check, while a degraded authentic vial that spent a week outside its cold chain will look perfect.
