International Regulatory Divergence
International regulatory divergence is the situation where one molecule holds different legal status in different countries, usually reflecting who filed where rather than a disagreement about evidence.
Regulators act on applications, not on molecules. A medicine is assessed only where a sponsor chooses to file, pays the fee and supplies a dossier suited to that agency, so a compound can be approved in one country, under review in a second, withdrawn from a third and never submitted to a fourth. Divergence therefore has causes that look identical from outside: genuine disagreement on benefit and risk, a commercial decision to skip a small market, a dossier that failed on manufacturing, or an authorisation that lapsed unused.
Cases separate the categories. Thymosin alpha-1 has been registered in a number of countries for hepatitis B while never holding US approval, which is a filing story rather than a verdict. Melanotan II holds no marketing authorisation anywhere and is not a divergence case at all. The European Union withdraws an authorisation not exploited within three years, so an EU listing can be historical. Approval dates for the incretin analogues differ by region and by indication. Registers change, and should be read directly from the regulator concerned.
The useful move is to convert approved abroad into a checkable statement: which agency, which product name, which indication, which date, and whether the entry is still live. Reference regulators publish searchable registers with assessment reports attached, and the report usually explains a divergence better than the decision does.
The error encountered most often is laundering. A product is called approved in Europe when what exists is a national food supplement notification, a cosmetic registration, or an authorisation for a different salt or indication. The mirror error treats absence of US approval as proof a compound is worthless, when for many older peptides it only means no sponsor thought a US filing worth funding.
